Welcome to Mala, a culinary recommendation application ("App"). These Terms of Service ("Terms") constitute a legally binding agreement between you and Mala governing your access to and use of the App and any related services.
By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the App. Your continued use of the App following any changes to these Terms constitutes your acceptance of those changes.
You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet the eligibility requirements. If you do not meet these requirements, you must not access or use the App.
To access certain features of the App, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are solely responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
The App collects and processes various types of user data in order to provide personalized culinary recommendations. This may include, but is not limited to, information about your food preferences, dietary restrictions, browsing behavior within the App, and location data when permitted. The App uses advanced algorithms to analyze this data and generate recommendations that align with your culinary preferences and needs. The quality and accuracy of recommendations depend on the information you provide and your interaction with the App.
You agree not to engage in any of the following prohibited activities: (a) copying, distributing, or disclosing any part of the App; (b) using any automated system to access the App; (c) attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the App; (d) uploading invalid data, viruses, or other software agents through the App; (e) impersonating another person or otherwise misrepresenting your affiliation; (f) collecting or harvesting any information from the App; (g) using the App for any commercial solicitation purposes; or (h) using the App in any manner that could disable, overburden, damage, or impair the App.
The App and its original content, features, and functionality are and will remain the exclusive property of Mala and its licensors. The App is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Mala.
We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App will immediately cease.
In no event shall Mala, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; (ii) any conduct or content of any third party on the App; (iii) any content obtained from the App; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
These Terms shall be governed and construed in accordance with the laws, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
